These Terms & Conditions are written to comply with the Consumer Rights Act 2015, the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, and the Digital Markets, Competition and Consumers Act 2024. Your statutory rights are always protected and cannot be excluded by anything in these terms.

We sell luxury 100% mulberry silk hair accessories under the brand name ELIZA H via our Etsy shop, website, and in person.
2. These Terms
These Terms & Conditions govern your purchase of goods from us. By placing an order you agree to be bound by them. These terms apply alongside and do not replace your statutory rights.
Under the Digital Markets, Competition and Consumers Act 2024 it is a criminal offence for a trader to mislead a consumer about their legal rights. We will never do so.
3. Our Products
All our scrunchies are crafted from 100% mulberry silk. Product descriptions and images are as accurate as possible. Colours may vary slightly due to photography and screen settings, which does not affect your statutory rights.
Under the Consumer Rights Act 2015, goods must be of satisfactory quality, fit for purpose, and as described. If they are not, your rights are set out in Section 8 below.
4. Ordering
A contract is formed when we accept and confirm your order. We reserve the right to refuse any order, in which case a full refund will be provided promptly.
5. Pricing & Payment
All prices are in pounds sterling (GBP). We accept:
• Debit and credit card via Etsy Payments, Shopify Payments, or in-person card reader
• Cash for in-person sales only
We accept debit and credit card payments securely via our website. Full payment is required before dispatch.
Full payment is required before dispatch. Under the Digital Markets, Competition and Consumers Act 2024, we display the total price of goods upfront with no hidden charges.
6. Delivery
We aim to dispatch within 3-5 working days. Under the Consumer Contracts Regulations 2013, if no delivery date is agreed we must deliver within 30 days. If we fail to do so, you may cancel and receive a full refund.
Risk passes to you on delivery to your specified address.
7. Hygiene Notice — Hair Accessories
Our scrunchies are hair accessories worn directly on and around the hair and scalp. Once removed from original sealed packaging and/or worn or used, they cannot be accepted back as change of mind returns. This is permitted under Regulation 28(3) of the Consumer Contracts Regulations 2013. This exemption does NOT apply to faulty goods. Your Consumer Rights Act 2015 rights for faulty goods are always fully protected.
8. Your Right to Cancel — Online Purchases Only
Subject to the hygiene notice in Section 7, you have 14 days from the day after receiving your goods to notify us of cancellation under the Consumer Contracts Regulations 2013. You then have 14 days to return the goods.
To cancel, email hello@elizahaccessories.co.uk with your order number. Return postage for change of mind cancellations is your responsibility. We will refund within 14 days of receiving returned goods or evidence of return, whichever is sooner.
9. Faulty or Misdescribed Goods — Your Statutory Rights
Under the Consumer Rights Act 2015:
• Within 30 days of delivery: right to reject and receive a full refund for faulty, misdescribed, or unfit goods
• 30 days to 6 months: right to repair or replacement (we will replace or refund if repair is not practical for scrunchies)
• After 6 months: rights continue but burden of proof shifts to you
These rights apply whether goods have been opened, worn or used. The hygiene exemption has no effect on faulty goods rights.
Report faults to hello@elizahaccessories.co.uk with your order number, description, and photographs.
10. Exchanges
We do not offer exchanges or store credit. Refunds only, where you have the right to return.
11. In-Person Sales
Consumer Rights Act 2015 rights apply in full for in-person purchases. There is no automatic right to return in-person purchases for change of mind. The hygiene notice applies equally.
12. Intellectual Property
ELIZA H is a trademark of Eliza H Accessories Ltd. A trademark application has been filed and approved with the UK Intellectual Property Office and is pending full registration. All content and branding is protected by UK law. You may not copy or use our intellectual property without written consent.
13. Limitation of Liability
Our liability shall not exceed the price paid for the goods. We are not liable for indirect or consequential losses. Nothing limits our liability for death or personal injury caused by negligence, or for fraud, or for any liability that cannot be excluded by law.
14. Alternative Dispute Resolution
If you are dissatisfied with our complaint handling, you may refer to an approved ADR provider. Details at https://www.gov.uk/government/publications/approved-alternative-dispute-resolution-bodies. Citizens Advice: 0808 223 1133.
15. Governing Law
These terms are governed by the laws of England and Wales. Disputes are subject to the exclusive jurisdiction of the courts of England and Wales.
